17th Judicial District Attorney's Office Files Vehicular Homicide Charges Against Jose Menjivar

Brighton, CO —Today, the 17th Judicial District Attorney’s Office is announcing the filing of Vehicular Homicide charges against Jose Menjivar, 37, related to a traffic crash near Main Street and Miramonte Boulevard in Broomfield on December 12, 2023, in which Melissa Powell, 46, and her son Riordan Powell, 16, were killed. 

Menjivar is charged with:  
  • Vehicular Homicide (F3)
  • Vehicular Homicide (F4)
  • Driving Under the Influence - Fourth or Subsequent Offense (F4)
  • Driving Under the Influence Per Se - Fourth or Subsequent Offense (F4)
Case number 2023CR000580 was filed in Broomfield County District Court. Menjivar's next court appearance is on December 21, 2023, at 1:30pm in Broomfield County Courtroom 1. 

The filing of a criminal charge is merely a formal accusation that an individual(s) committed a crime(s) under Colorado laws. A defendant is presumed innocent until and unless proven guilty. See Colo RPC 3.6.
